Terms

1. Scope

Hedinger-Digital operates api-hub.ch and offers usage-based utility APIs through it. These terms apply to the use of the website and the paid API services.

2. Services

The services consist of the utility APIs described on api-hub.ch. Features and pricing are set out on the respective product pages. Consulting is not included unless separately agreed.

3. Formation of contract

The contract is formed via Stripe Checkout. After successful payment you receive a confirmation and an API key to use the purchased service.

4. Prices and payment

Prices are as published on the website in CHF. Where offered, subscriptions include a free usage quota; usage beyond that is billed on a metered basis via Stripe. Taxes, if applicable, follow Stripe or the invoice.

5. API keys and use

API keys must be kept confidential. You are responsible for the security of your keys. Prohibited in particular are reverse engineering for abusive purposes, unlawful use, overloading the services, and attacks on systems or other users. Fair use applies. We may suspend access for abuse or non-payment.

6. Availability

Services are provided on a best-effort basis. No service level agreement (SLA) is guaranteed unless separately agreed. Maintenance may cause temporary downtime.

7. Warranty

We provide the services with due care. To the extent permitted by law, no warranty of uninterrupted or error-free operation is given for free tier usage and standard subscriptions; mandatory statutory rights remain unaffected.

8. Liability

Liability for intent and gross negligence is unlimited. For slight negligence we are liable only for breach of essential contractual duties and limited to typical foreseeable damage. Where legally excludable, we are not liable for indirect or consequential damages. Product liability and liability for personal injury remain unaffected.

9. Privacy

Information on the processing of personal data is set out in the Privacy Policy.

10. Termination

Subscriptions may be cancelled via the Stripe customer portal or by contacting kontakt@hedinger-digital.ch. Access continues until the end of the paid period unless revoked for breach.

11. Changes

We may update these terms. Where changes are material, we will provide notice in an appropriate manner. Continued use after the updated terms take effect for future billing periods may constitute acceptance; mandatory rights remain unaffected.

12. Governing law / venue

Swiss law applies, excluding conflict-of-law rules. Exclusive venue is the courts at the provider's registered office in 7205 Zizers (Canton of Graubünden), subject to mandatory consumer protection provisions where applicable.

13. Severability

If any provision of these terms is invalid or unenforceable, the remaining provisions remain in effect. The invalid provision shall be replaced by a provision that most closely reflects the economic purpose.
